Draft by-laws for the new Public Procurement Law ready

At the workshop: “Drafts of implementing regulations according to the draft new Public Procurement Law”, experts working on the Project and representatives of the Public Procurement Office spoke about the drafts  of implementing regulation prepared in respect to draft new Public Procurement Law.

“The new Public Procurement Law is at the final stage of elaboration and what is to follow is its adoption. We have decided that we would already prepare draft by-laws in respect to draft new Public Procurement Law, together with the Public Procurement Office,” said Teja Kolar, IPA Project team leader.

 

 

IPA Project experts helped with the elaboration of these by-laws of the Public Procurement Office, and based on good practice examples from the region and the European Union, in order to have them fully harmonized with the highest standards in the public procurement segment.

At the workshop, drafts of new rulebooks produced in accordance with the draft New Law At, which include the draft Regulation on the content of tender documents, Regulation on the public opening of tenders, Regulation on the monitoring of the Public Procurement Office and a standard form of a declaration of fulfilment of criteria for qualitative selection of economic operators.

 

 

Ivan Palčić, public procurement expert, pointed out that the objective of the regulations was to uniform the actions of the contracting authority in public procurement procedures and to increase the level of legal security and efficiency for all participants in the procedure.

„For example, the objective is to uniform the contents of tender documents for different types of public procurement procedures. Monitoring the entire process is also of great importance, in order to reduce the risk of corruption and numerous other irregularities,” stressed Palčić, who currently holds the position of the head of department at the Public Procurement Policy Office at the Croatian Ministry of Economy.

 

 

Zvonimir Jukić, e-procurement expert, presented to the workshop participants one of the models for reduction of administrative burden for economic operators in public procurement procedures.

In order to relief the administrative burden for economic operators, we have also prepared a draft of the declaration of fulfilment of criteria for qualitative selection of economic operators. This standard form of declaration replaces the obligation of providing evidence documentation along with the tender, which only the winner ultimately has to deliver at the end of the process of expert evaluation of the tenders – this saves time and improves efficiency,” Jukić concludes, whose work is specifically dedicated to the Croatian e-public procurement website.
